Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Cardly, the digital business card platform operated at getcardly.io (“Cardly”, “we”, “us”, or “our”). Please read these Terms carefully before creating an account or using the service.
1. Acceptance of Terms
By creating an account, accessing, or using Cardly in any way, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use Cardly.
2. Account Registration
- Age requirement — you must be at least 18 years old to create an account. By registering, you represent that you meet this requirement.
- Accurate information — you agree to provide accurate, current, and complete information during registration and to keep it up to date.
- Account security — you are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. Notify us immediately at support@getcardly.io if you suspect unauthorised access.
- One account per person — each person may maintain only one personal account unless you are on a Team plan.
3. Free and Paid Plans
Cardly offers a free tier and paid subscription plans (Pro and Team) as described on our pricing page.
- Free plan — available indefinitely with the features described at the time of registration. We reserve the right to modify free plan features with reasonable notice.
- Paid plans — billed monthly or annually. All payments are processed securely by Lemon Squeezy. By subscribing, you also agree to Lemon Squeezy's terms of service.
- Price changes — we will give at least 30 days' notice before increasing prices for existing subscribers.
4. Cancellation and Refunds
- You may cancel your paid subscription at any time from your account settings or by contacting support.
- Upon cancellation, you retain access to paid features until the end of your current billing period. No partial refunds are issued for unused time unless required by law.
- If you delete your account, all data is permanently removed within 30 days as described in our Privacy Policy.
5. Acceptable Use
You agree not to use Cardly to:
- Publish or distribute spam, unsolicited messages, or malicious content.
- Impersonate any person or entity, or misrepresent your affiliation with any person or organisation.
- Upload or share content that is unlawful, defamatory, obscene, infringing, or otherwise objectionable.
- Attempt to gain unauthorised access to any part of the service, its servers, or any data belonging to other users.
- Use automated tools to scrape, crawl, or harvest data from the platform without our prior written consent.
- Resell, sublicense, or otherwise commercialise the service without our express written permission.
We reserve the right to suspend or terminate accounts that violate these rules without prior notice.
6. Intellectual Property
- Your content — the text, images, and other content you add to your card remains yours. You grant Cardly a limited, non-exclusive licence to store and display that content solely for the purpose of operating the service.
- Cardly platform — the Cardly name, logo, website design, software, and all associated intellectual property are owned by Cardly and may not be used without our prior written consent.
- Feedback — if you provide suggestions or feedback about the service, we may use that feedback without restriction or compensation.
7. Disclaimers and Limitation of Liability
Service provided “as is” — Cardly is provided without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the service will be uninterrupted, error-free, or free of harmful components.
Limitation of liability — to the fullest extent permitted by applicable law, Cardly shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or related to your use of the service, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim, or €100, whichever is greater.
8. Changes to These Terms
We may update these Terms from time to time. For material changes, we will provide at least 30 days' notice by email or by posting a prominent notice on the platform. The updated “Last updated” date at the top of this page will always reflect the current version. Continued use of Cardly after the effective date of any changes constitutes your acceptance of the new Terms.
9. Governing Law and Disputes
These Terms are governed by the laws of the Republic of Serbia, without regard to conflict-of-law principles. For users in the European Union or EEA, mandatory consumer protection laws of your country of residence also apply, and EU GDPR governs the processing of your personal data. Any dispute arising from these Terms shall first be attempted to be resolved amicably by contacting us at support@getcardly.io.
